These Terms of Service (“Terms”) govern your access to and use of the Provata website, services, and appraisal reports (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.
The Service
Provata provides market-based appraisal reports for classic and collector vehicles. Appraisals are based on information you provide about your vehicle, photographs you upload, and comparable sales data available at the time the report is issued. Reports are intended to support insurance coverage, sale pricing, estate valuation, or other legitimate uses for which a documented vehicle valuation is required.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep your account information up to date. Notify us immediately if you suspect unauthorized use of your account.
Accurate Information
The accuracy of your appraisal depends entirely on the accuracy of the information and photographs you provide. You represent and warrant that:
- All information you submit is truthful and accurate to the best of your knowledge
- Photographs you upload are of the actual vehicle being appraised
- You own the vehicle or have explicit permission from the owner to submit it for appraisal
- You have the right to share any information or photographs you submit
Misrepresentation, including submitting photographs of a different vehicle or falsifying vehicle details, may result in an invalid appraisal, account termination, and potential legal consequences. Fraud may also affect your insurance coverage.
Appraisal Disclaimer
Provata appraisal reports are professional opinions of value based on available market data, submitted vehicle information, and methodology current at the time of issuance. Reports are not guarantees of sale price or insurance payout. Vehicle values fluctuate based on market conditions, and concluded values represent a supportable figure as of the report's effective date.
Provata does not physically inspect vehicles. Appraisals rely on information and photographs submitted by the owner. We make reasonable efforts to verify submitted information but cannot guarantee its accuracy. Provata is not liable for losses arising from inaccurate information submitted by the user.
Acceptable Use
You agree not to:
- Submit fraudulent, misleading, or false information
- Submit photographs that are not of the actual vehicle being appraised
- Attempt to tamper with or alter an issued appraisal report or verification code
- Use the Service to misrepresent vehicle value for fraudulent insurance claims
- Share your account with others or allow unauthorized access
- Interfere with the Service's operation, security, or availability
- Use automated means to access the Service without our express written permission
- Violate any applicable laws or regulations
Payment and Refunds
When payment processing is active, appraisal reports are issued upon successful payment. Fees are listed on our pricing page and may change over time. Changes apply only to appraisals initiated after the fee change takes effect.
Because appraisal reports represent substantial research effort and are usable immediately upon issuance, all sales are final once a certified report has been generated and delivered. If you believe your report contains factual errors, contact us at appraisals@provata.ai and we will review the specific concerns raised.
Verification Codes
Each certified appraisal report includes a unique verification code. The code allows a third party, such as an insurance underwriter, to confirm the report's authenticity and issue date. You control who receives the code. Once issued, a verification code cannot be revoked. If you have security concerns about a shared code, contact us promptly.
Ownership and License
Provata retains all rights to the Service, including its design, brand, methodology, and report templates. You retain ownership of the vehicle information and photographs you submit, but you grant Provata a non-exclusive, worldwide, royalty-free license to use that content for the purpose of producing and supporting your appraisal report, and for improving the accuracy of our methodology in aggregate, anonymized form.
Appraisal reports are provided to you for your use and the use of parties with whom you share verification codes. You may not resell, redistribute, or republish reports without written permission.
Limitation of Liability
To the fullest extent permitted by law, Provata's total liability for any claim arising from or related to the Service or an appraisal report is limited to the amount paid for the report in question. Provata is not liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
The Service is provided “as is” and “as available.” Provata disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.
Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if we believe you have violated these Terms, submitted fraudulent information, or if required by law. Previously issued certified reports remain valid and verifiable after account termination unless specifically revoked for cause.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms on this page with a revised “last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Ontario, Canada.
